It's benign, not sure what the problem is...

It's a proprietary check to execute "stuff" (such as CSS rules) for versions of IE less than 7 (eg 6)

Although it's empty, so it's not being used, I guess you could say it's redundant at worst...

yeah we had the theme custom designed and the designer was a little 'off'. I had it checked today and am told all it does is call different css file for earlier versions of IE.
